§1 GENERAL ISSUES
- These regulations apply to the sale of digital products in the zoukdiverse.com online store , with the proviso that the regulations of the organizers of individual artistic events (including performances, concerts and other events) or direct sellers may impose additional obligations on buyers not listed in these regulations. Each customer, at the latest when expressing his will to be bound by a distance contract with Dominika Kureczko Bodiemotion, NIP: 1182249621, has the opportunity to read and accept these regulations and is informed about his rights and obligations.
- By agreeing to the terms of purchase, the buyer declares that he has read and accepts these regulations and that he agrees to the processing of data for marketing purposes.
- The zoukdiverse.com online store is run by Dominika Kureczko Bodiemotion, NIP: 1182249621, REGON 523351335

- The expressions used in these Regulations mean, unless indicated otherwise, as below:
a) Event – any specific event, cultural, musical or other show that is carried out by the Organizer
b) User – any person using the online store com to purchase a ticket for an event offered by Dominika Kureczko Bodiemotion, NIP: 1182249621
c) Customer – a User who purchased a Ticket for the Event via the online store.
d) Dominika Kureczko Bodiemotion, NIP: 1182249621.
e) Ticket – an electronic document confirming the Customer’s right to use the event.
f) Amount due – this is the amount that the User should ultimately pay after successfully placing the Ticket order. The amount consists of the price of selected Tickets, the cost of all elements of the order selected by the User, in accordance with the Regulations and the price list.
§2 USER ACCOUNT
- In order to use the online store, it is necessary to have a device that allows access to the Internet, including a program for browsing its resources
- In order to set up a full account in the online store, the User should provide an e-mail address and password, and then complete the data necessary for the full use of the account, including the execution of the order, i.e.:
a) e-mail address.
b) name and surname.
c) contact telephone number.
- By creating a full account in the online store zoukdiverse.com , the User agrees to conclude an agreement with zoukdiverse.com for the provision of electronic services. The terms of the Agreement are set out in these Regulations. Consumers may withdraw from this agreement by providing written notice to zoukdiverse.com within 14 days of entering into this agreement. If the user purchases a Ticket in the online store, he loses the right to withdraw from the contract.
- zoukdiverse.com is not responsible for incorrect entering of data by the User into the online store or for changing the data in the online store by the User, in particular address data.
- zoukdiverse.com may make changes to this Agreement at any time by notifying the user of this fact by e-mail and placing the amended version of the Agreement in the online store. Each amended version of the Agreement will apply to newly registered Users from the date of placing the Agreement in the online store. For Users already registered, the amended version of the Agreement will be binding after 14 days from the date of notification.
- zoukdiverse.com may terminate the Agreement with immediate effect in the event of gross abuse of the Terms and Conditions by the User, resale of Tickets by the User or reasonable suspicion by zoukdiverse.com of the User committing a crime. Termination of the Agreement results in the deletion of the User’s account in the online store.
- The User undertakes to repair damages caused to zoukdiverse.com and to hold harmless zoukdiverse.com from any claims or demands, including reasonable attorneys’ fees, made by third parties arising directly from the User’s violation of the provisions of the Agreement or any third party right.
- This Agreement may be terminated at any time with immediate effect by written notice.
- 3 PURCHASING AND TICKET DELIVERY
- The process of purchasing a Ticket via the online store consists of the following stages:
a) selection of the Event.
b) selection of the category and type of Ticket, if there is a choice in this regard.
c) selection of possible additional elements of the order.
d) possibly logging in/registration in the online store.
e) providing/supplementing the contact details necessary for the execution of the order, in particular the delivery of the Ticket.
f) verification of the order, including the amount due, and acceptance of the conditions of purchase of the Ticket and granting consent to the processing of personal data in order to complete the order.
g) confirmation of the order by the User with the obligation to pay.
h) confirmation of the terms and execution of the order by com by sending a message to the e-mail address provided.
- After selecting the product and the type of Ticket, the User is obliged to accept the conditions of purchasing the Ticket, check the data entered by the User into the online store and confirm the willingness to complete the order by pressing the “Order with obligation to pay” button.
- During the ticket purchase process, the subsequent steps of booking and purchasing tickets must follow each other continuously.
- After selecting the payment method, the User follows the instructions of the online store
.
- After zoukdiverse.com receives information about the Customer’s payment, the Customer receives an electronic confirmation to the e-mail address indicated by him.
- The ticket has a unique number and allows one-time entry for one person.
- The price of the Ticket for the selected pass is the normal price, without discounts.

- The customer is obliged to pay the amount resulting from the placed order within the time limit indicated by zoukdiverse.com . Failure to pay the order on time will be considered as the User’s withdrawal from the contract and such an order will be automatically canceled.
- In case of cancellation of the order, in accordance with sec. 10 above, it is not possible to restore it, but it is only possible to place a new order. In this case, zoukdiverse.com cannot guarantee that the selected Tickets will still be available.
§4 PAYMENTS
- When ordering Tickets and making payments for them, the Customer is obliged to exercise due diligence. Entering incorrect data, e.g. the transfer amount, booking code or payer’s details that prevent identification of the Customer, may result in refusal to book the payment and cancellation of the transaction.
- When purchasing tickets online, the Customer may make a payment using the options available in the online store.
- The amount due under the order should be paid in full immediately after placing the order. Failure to pay for the order within the time indicated by the online store will be considered as failure to conclude the contract by the User and such an order will be automatically canceled.
- Any possible costs related to making payments for the Ticket, in the manner provided for in this provision of the Regulations and the regulations of third parties, accepted by the User in the purchase process, shall be borne by the User.
- zoukdiverse.com reserves that in the event of a short time remaining to the Event, it may not be possible to purchase an Event Ticket.
- The Customer may request a VAT invoice for paid Tickets. In this case, he must make such a request to info@zoukdiverse.com. The VAT invoice will be sent in electronic form to the e-mail address indicated in the order by the User. By accepting the Regulations, the User agrees to receive invoices in electronic format in accordance with the VAT Act and other applicable laws.
- A ticket purchased in the manner specified in the Regulations does not entitle to a refund or exchange for another, except in the event of cancellation of the event, change of date or place of the Event. In the event of cancellation of the Event, change of the date or place of the Event, the Customer will be able to exchange the Ticket for another one or refund the money, in accordance with the provisions of §5.
§5 TICKETS, RETURNS, COMPLAINTS
- The Customer is obliged to check the information on the Ticket against the data contained in the order placed by the Customer.
- The Ticket allows a single entry to the Event for the person indicated on the Ticket.
- The ticket delivered by zoukdiverse.com to the Customer is an online email confirmation of being on Participant’s list. After showing his ID-Card or Passport at the reception during the event, the Customer will receive a wristband which will allow them to enter the venue and participate in the Event organized by Dominika Kureczko Bodiemotion, NIP: 1182249621.
- If the delivered Ticket is illegible, destroyed, damaged or inconsistent with the order, the Customer should immediately notify Dominika Kureczko Bodiemotion, NIP: 1182249621.
- zoukdiverse.com does not refund or exchange tickets purchased via the online ticket sales store – except for situations where the Event is cancelled, the date or venue of the Event is changed.
- The customer concluding a contract in the online store zoukdiverse.com off-premises or remotely, in accordance with art. 38 point 12 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 24 June 2014), there is no right to withdraw from the contract without giving a reason, referred to in art. 27 of the Act of May 30, 2014 on consumer rights.
- Tickets not used for reasons other than those listed in the sections below cannot be returned or exchanged.
In case of cancellation of the Event due to reasons beyond the control of the organizer, he undertakes to refund the full amount of the entrance ticket, while he does not bear the additional costs incurred by the participant (transportation, accommodation, etc.).
- Decisions regarding cancellation of the event, refunds for cancellation of the event, replacement of the ticket, refusal of admission to the event, ordering to leave the event, change of the program of the event, change of the seat of the ticket holder are made by Dominika Kureczko Bodiemotion, NIP: 1182249621.
- The customer has no right to apply for reimbursement of additional costs incurred, such as hotel, travel, etc.
- zoukdiverse.com is not responsible for the consequences of providing false or incorrect data in the order form.
- If you want to submit a complaint in connection with the inconvenience, as part of some events, the entity obliged to consider the complaint and responsible to the Customer is zoukdiverse.com. Complaints should be sent by the customer immediately to the e-mail address info@zoukdiverse.com, Dominika Kureczko Bodiemotion, NIP: 1182249621 of the event is obliged to consider the complaint within 14 days.
- zoukdiverse.com reserves the right to end online sales at any time without giving reasons.
- In case of an event participant not being able to participate in the event, after registration and payment, there is an option of refund within 14 days after the purchase. In order to get it, contact the organizer at info@zoukdiverse.com
- Zouk Diverse is entitled to cancel the order/Ticket when:
a) You have made a payment using stolen credit cards.
b) The User has issued the Ticket for resale.
c) The ticket has not been paid for.
d) You bought a pass which does not fit your dance role (e.g. You bought a leader pass, although you are not a leader for almost 100% of the time during an event)
§6 ADMISSION TO THE EVENT
- Before purchasing Tickets, the Customer is obliged to read these Regulations and detailed information regarding a given event. During some Events, special effects may be used, such as sound, audiovisual, light and pyrotechnic effects, which may be health contraindications for some people.
§7 PERSONAL DATA PROTECTION
- Information obligation: Please be advised that the administrator of Users’ personal data is Dominika Kureczko Bodiemotion, NIP: 1182249621. Your personal data will be processed for the purposes indicated in the Regulations. You have the right to request access to your personal data, rectification, deletion or limitation of processing, the right to object to the processing, as well as the right to transfer data. Providing data is voluntary, but necessary for zoukdiverse.com to perform the services available in the online store. Personal data will be stored on the terms and for the period specified in the Regulations, in accordance with EU and Polish regulations on personal data. At the same time, we would like to inform you that the User has the right to lodge a complaint with the supervisory authority. If the basis for the processing of personal data is the User’s consent, the User has the right to withdraw the consent at any time. Withdrawal of consent does not affect the lawfulness of data processing, which was made on the basis of consent before its withdrawal. The consent is independent of the time in which the User uses the services, it is valid until revoked.
- The User agrees to the processing of his personal data by the Administrator in order to complete the order, purchase the Ticket and handle returns and complaints.
- The user agrees to the processing and transfer of his personal data to entities cooperating with zoukdiverse.com in the field of ticket sales. The User’s data may be transferred in particular to the following entities: processors in connection with the performance of Ticket sales services, cooperating entities and contractors, law firms to which the Administrator may commission proceedings, entities or bodies authorized under the law, entities that are responsible for handling online store, to third parties in order to handle payments.
- If the User gives separate consent, zoukdiverse.com may process his personal data for marketing purposes related to the sale of Event Tickets, e.g. delivery of newsletters. Failure to express such consent by the User does not affect the provision of ticket sales services by zoukdiverse.com .
- In the case of named Tickets, the User agrees to include his/her personal data on the Ticket purchased, such as name and surname and other necessary, if required by the security of the Event .
- The User’s personal data will not be stored by the Administrator for longer than it is necessary to achieve the purposes for which they were collected or longer than required by law. In the absence of other deadlines resulting from mandatory provisions of law, the storage period is 10 years.
§9 LIABILITY
- The user should inform zoukdiverse.com of any irregularities in the functioning of the online store. zoukdiverse.com is not responsible for the temporary unavailability of the online store due to technical reasons or circumstances beyond zoukdiverse.com ‘s control and beyond zoukdiverse.com’s control (force majeure).
- zoukdiverse.com stipulates that if the Ticket was a personal ticket, then in the event that it turns out that the data contained on the ticket differ from the data of the Ticket holder, Dominika Kureczko Bodiemotion, NIP: 1182249621 has the right to refuse to admit such a person to the Event, for which the Ticket was purchased.
- zoukdiverse.com is not responsible for the User’s behavior within the online store or for improper performance or non-performance of contracts concluded as part of the purchase of Tickets, as well as for the consequences of actions taken by Users and third parties that constitute a violation of the provisions of the Regulations.
§10 FINAL PROVISIONS
- These Regulations come into force on January 31, 2023.
- With regard to any issues related to a given order, the Regulations in force on the date of placing the order shall apply.
- In the event of disputes with the User, the local and material jurisdiction of the court is determined by the provisions of the Code of Civil Procedure. The Regulations do not modify the general rules.
- The Regulations may be changed from time to time by placing changed versions of the Regulations in the online store. In the case of Users who have an account in the online store, the changes become effective after 14 days from the date of their placement in the online store. If the User with an account in the online store does not accept these changes, he should terminate the use of the online store by terminating the Agreement for the provision of electronic services concluded in accordance with §2 above. Each amended version of the Regulations will apply to newly registered users from the date of placing the Regulations in the online store.
